1.Who we are
AVArx ("AVArx," "we," "us," or "our") is operated by AVArx LLC, located at 6034 San Fernando Rd, Glendale, CA 91202. AVArx operates a technology platform that connects you with independent, U.S.-licensed medical providers and with licensed pharmacies that may dispense medications prescribed to you. Our services are available to residents of all 50 U.S. states.
AVArx is not a pharmacy, a medical practice, or a provider of healthcare. We do not practice medicine, dispense medication, or provide medical advice, diagnosis, or treatment. All clinical decisions are made solely by the independent licensed providers you consult through the platform. All medications are dispensed by independent licensed pharmacies.
2.Eligibility
To use AVArx you must be at least 18 years old, reside in the United States, and be able to form a legally binding contract. By using the platform you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.
3.The platform is not a substitute for emergency care
AVArx is not designed for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the platform to request emergency care.
4.Relationship with providers and pharmacies
The medical providers available through AVArx are independent professionals who are solely responsible for the care they provide. The pharmacies that dispense medication are independently licensed and solely responsible for fulfillment. AVArx does not control, and is not responsible for, the clinical judgment of any provider or the dispensing decisions of any pharmacy.
A provider may determine, in their independent clinical judgment, that a requested treatment is not appropriate for you. Submitting a request or completing an intake does not guarantee that you will receive a prescription or any particular treatment.
5.Consent to telehealth
Care offered through the platform is provided by independent, licensed practitioners of Arora Health & Aesthetics, LLC by means of asynchronous telemedicine. Before receiving care, you will be asked to review and agree to our Consent to Telehealth, which explains how asynchronous telemedicine works, its risks and benefits, and your rights. By consulting with a provider you consent to receive services via telehealth, you understand the provider may determine telehealth is not appropriate for your situation, and you may withdraw your consent at any time.
6.Payments and billing
Fees for consultations, products, subscriptions, and shipping are disclosed before you complete a purchase. By providing a payment method, you authorize us (or our payment processor) to charge all fees you incur. Where you enroll in a recurring subscription, you authorize recurring charges until you cancel in accordance with the cancellation terms presented at checkout.
Refunds and cancellations are governed by our Shipping & Returns policy. Because of federal and state law, prescription medications cannot be returned once dispensed and shipped.
7.Acceptable use
You agree not to: provide false information; use the platform on behalf of another person without authorization; resell, divert, or misuse any medication; attempt to gain unauthorized access to the platform; or use the platform for any unlawful purpose. We may suspend or terminate your access for any violation of these Terms.
8.Intellectual property
The AVArx name, logo, website, and all related content are owned by AVArx LLC or its licensors and are protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.
9.Medical disclaimer
Information made available through the platform that is not part of a consultation with your provider is for general informational purposes only and is not medical advice. Always seek the advice of a qualified healthcare professional with any questions about a medical condition.
10.Disclaimer of warranties
Except as expressly stated, the platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or secure.
11.Limitation of liability
To the fullest extent permitted by law, AVArx LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the platform. Because AVArx does not provide medical care, AVArx is not liable for the acts or omissions of any independent provider or pharmacy.
12.Indemnification
You agree to indemnify and hold harmless AVArx LLC from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the platform or your violation of these Terms.
13.Governing law & dispute resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the platform will be resolved by binding arbitration administered by the American Arbitration Association under its applicable rules, seated in Los Angeles County, California, except that either party may bring an individual claim in small-claims court. To the extent permitted by law, you and AVArx waive any right to a jury trial and to participate in a class action.
14.Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Effective" date above. Your continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
